On January 30, 2024, the Bavarian State Social Court ruled that the costs of storing sperm or eggs as part of a germ cell-damaging therapy must be reimbursed by the statutory health insurance fund. This applies if you have stored sperm or eggs with us or are planning to do so.

We recommend that same-sex couples, regardless of whether they are dating, married or unmarried, conclude a contract with a notary prior to treatment (e.g. www.notarin-balzer.de). As a general guideline, the following points should be clarified:

  • Adoption by the co-mother after the birth of the child
  • the right of custody/access to the child in the event of a separation
  • The payment of alimony to the mother, who takes care of the child and cannot be (fully) employed, in case of separation
  • custody of the co-mother in the event of the mother’s death between the birth of the child and the completion of the adoption procedure.

In the case of same-sex couples, both mothers can be registered as legal parents in the birth certificate at the earliest one year after the child’s birth.

This is done after the completion of the adoption process.
