Anonymity of the sperm donor

The identity of the donor is generally not disclosed to the intended parents. Only the child, or in exceptional cases the parents on behalf of a child under the age of 16, can request information about their genetic parentage from the Erlangen sperm bank or the BfArM in Cologne when they reach the age of 16 and wish to find out the identity of their donor – provided that the parents have informed the child about the circumstances of their conception.

Duties of the sperm donor

As a donor of the Erlangen Sperm Bank, you must agree to provide. all personal information truthfully, in particular information about previous illnesses and hereditary diseases. You must also agree to not take part as a donor in any other sperm bank or to donate sperm privately.

Possible claims of a child from donor sperm treatment

A child resulting from donor sperm treatment is considered the same as a biological child of the intended parents. Child support and inheritance claims of a child from donor sperm treatment are therefore directed to the legal parents, even in the case of unmarried couples and single mothers.

Since the Sperm Donor Register Act came into force on July 1, 2018, a sperm donor can no longer be established as the legal father after a medical donation at a sperm bank.

Even if the child is aware of its genetic parentage, the donor CANNOT be established as the father.

A person from donor sperm treatment therefore has no legal claims to child support payments or inheritance from his or her genetic father. 

Revocation

You can revoke your decision to be registered and active as a donor with us in writing at any time. If you withdraw during the donation cycle, all samples will be destroyed immediately. You must then reimburse the full amount of the expense allowance.

If you only revoke your decision after the samples have been released, we can – against payment of a corresponding fee – only destroy those samples that have not yet been purchased.
