Data protection information for sperm donors

The protection of your privacy is of the utmost importance to us. We have received the data from you as part of your application as a sperm donor and, if applicable, as part of your sperm donation. We collect and use your data for our own purposes in accordance with the General Data Protection Regulation (GDPR).

Reason for shared responsibility

The Erlangen Sperm Bank and the gynecologists’ group practice work closely together. This also applies to the processing of your personal data. The parties have jointly determined the order in which this data is processed in the individual phases. They are therefore jointly responsible for the protection of your personal data within the phases described below (Art. 26 GDPR).

  • Collection of master data and medical data in connection with appointment allocation and registration.
  • Collection of medical data in connection with the preliminary examination and storage (documentation of findings).
  • Processing of data in the context of storage (storage of semen samples).
  • Disclosure of the data collected (without identifying data) for the purpose of shortlisting couples who wish to have children.
  • Processing by transmission (without identifying data) to an eligible person resulting from the sperm donation for the purpose of preparing a careful and considerate contact (as an alternative to the procedure for establishing contact by the Federal Institute for Drugs and Medical Devices in Bonn, BArfM).

Responsibility

The parties have agreed that the ivf company is responsible for all processing phases. The ivf company also fulfills the information obligations pursuant to Art. 13 and 14 GDPR and the processing of and response to requests to exercise the rights of data subjects.

Purpose and legal basis of the processing

We collect and process your personal data on the basis of legal requirements, such as the Sperm Donor Register Act (SaRegG) of 17 July 2017 for the purpose of complete traceability of patient and tissue identity and to fulfill the contract between the donor and the Erlangen Sperm Bank (KSB) as well as the associated obligations. The collection of personal data is a prerequisite for your sperm donation. If the necessary information is not provided, the donation cannot take place.

Data processing is carried out on the legal basis of Art. 6 para. 1 sentence 1 lit. b) GDPR and Art. 6 para. 1 lit. c) GDPR.

We will only process your data, in particular your special personal data, insofar as it is relevant for the execution of the sperm donation contract, including medical activities in connection with the sperm donation, if you consent to this. In this case, your consent is the legal basis for data processing in accordance with Art. 9 para. 2 sentence 1 lit. a) GDPR. You can withdraw your consent at any time with effect for the future. However, revocation does not affect the legality of the data processing carried out on the basis of the consent until revocation. In this case, the data will be stored until you withdraw your consent.

Furthermore, your special personal data will be processed by laboratories on the basis of your consent in accordance with Art. 9 para. 2 sentence 1 lit. a) GDPR, insofar as this is necessary for the medical activity in connection with sperm donation.

The reception of the group practice coordinates the registration and appointment allocation for sperm donors and serves as a central point of contact. The doctors at the group practice carry out the examinations for the donation, document the findings and carry out the explanatory talks. The blood laboratory arranges appointments with the donors, takes the blood samples and receives and sends the urine samples and test material. The hormone laboratory receives and checks the donations and test materials.

We will only pass on your personal data, some of which is special, to a person entitled to claim under the SaRegG resulting from the sperm donation in a personal conversation for the purpose of making considerate contact if you consent to this. In this case, your consent is the legal basis for data processing in accordance with Art. 9 para. 2 sentence 1 lit. a) GDPR and Art. 6 para. 1 lit. a) GDPR. You can withdraw your consent at any time with effect for the future. However, revocation does not affect the legality of the data processing carried out on the basis of the consent until revocation. In this case, the data will be stored until you withdraw your consent.

Recipient

Your personal data will be processed by the employees of the responsible body.

Furthermore, your personal data will be processed by the joint practice of the gynecologists Drs. Behrens/Hammel, Nürnberger Straße 35, 91052 Erlangen, Germany, on the basis of your consent, insofar as this is necessary for the medical activity in connection with the sperm donation. Recipients of your personal data may also be other doctors in this context. The transmission is mainly for the purpose of clarifying any medical questions that may arise.

Your personal data (surname and, if different, maiden name, first names, date and place of birth, nationality and address as well as his individual donor code) and, if applicable, your voluntary information in accordance with the SaRegG (e.g. external appearance, school education, occupation, hobbies and interests, reasons for sperm donation) will be forwarded to the BArfM or a successor authority in the event of a pregnancy becoming known or unknown to us on the basis of legal requirements, where this data will be stored for 110 years in strict compliance with data protection regulations and communicated exclusively to entitled persons.

If necessary, your personal data will be passed on to a person entitled to claim under the SaRegG in a personal interview on the basis of your consent. This includes, for example, biometric data, professional career, interests or a photo, but not name, date of birth, place of birth or place of residence. The purpose of this disclosure is to establish careful and considerate contact between the eligible person and the donor, which cannot currently be guaranteed under the SaRegG.

If necessary, your personal data will be processed by laboratories and IT service providers acting on our behalf.

Transfer to a country outside the EU

Your personal data will not be transferred to a country outside the EU.

Data categories

The following data categories are affected: Surname and, if different, maiden name, first names, date and place of birth, nationality, and address as well as an individual donor code.
If applicable: information about the profession learned, school education, hobbies and interests, reasons for sperm donation or physical appearance.

Furthermore, the following special categories of personal data are affected in accordance with Art. 9 para. 1 GDPR Health data, ethnic origin (for the matching process with the intended parents), genetic data and data on sexual life.

How long your personal data will be stored

We store your data for as long as this is necessary for the performance of the contract and/or if statutory retention obligations prevent the deletion of your data. Due to legal requirements, we are obliged to store your data for at least 10 years after completion of the treatment.

In the case of processing based on consent, we store the data until such consent is withdrawn.

Rights of data subjects

You are entitled to the following statutory data subject rights, provided that their requirements are met:

  • Right to information about your data stored by us in accordance with Art. 15 GDPR,
  • Right to rectification of inaccurate data in accordance with Art. 16 GDPR,
  • Right to erasure of the data stored by us in accordance with Art. 17 GDPR,
  • Right to restriction of the processing of data stored by us in accordance with Art. 18 GDPR,
  • Right to data portability pursuant to Art. 20 GDPR,
  • Right to object pursuant to Art. 21 GDPR,
  • Right to lodge a complaint with a competent supervisory authority pursuant to Art. 77 GDPR if you consider that the processing of personal data relating to you infringes the provisions of the GDPR.
